Why File CGT Return?
In the UK, if you dispose of residential property and incur a taxable gain, you must report and pay Capital Gains Tax within 60 days of completing the property sale or disposal. This rule applies to UK residents as well as non-residents disposing of UK residential properties.
Disposing of a residential property means:

Selling a residential property
Transferring property via a deed or declaration of trust
Granting a lease out of a residential property.
Gifting property other than to a spouse or civil partner
The 60-day countdown begins from the completion date of the disposal, not the exchange date. It is crucial to adhere to this deadline to avoid penalties and interest. The 60-day CGT return requires you to declare the gain, calculate the tax owed and pay it to HMRC within this timeframe.
From accurate tax estimates to in-depth knowledge, our residency checker and eBook are here to support you in every step of your CGT tax return journey.
CGT applies to both residents and non-residents disposing of residential properties in the UK. If you are unsure about your residency status, use of form to check and learn how we can guide your through your tax obligations.

General queries by our clients regarding Filing Capital Gains Tax Return are answered here.
Yes, you may need to pay Capital Gains Tax (CGT) when transferring properties to your children or relatives unless specific exemptions or reliefs, such as Private Residence Relief, apply.
When transferring a property, HMRC treats it as though the property was sold at its market value, even if it was gifted or sold below market price. Additionally, Inheritance Tax (IHT) may also be a consideration if the transfer involves gifting the property at a value below its market rate.
As a result, transfers to relatives are generally subject to CGT, unless the transaction qualifies for applicable reliefs or exemptions.
You might have to pay CGT even if you are not a UK citizen. This depends upon your residency status.
If you're a UK tax resident, you will generally be liable for CGT on worldwide gains, meaning any assets you sell, regardless of where they are located, may be subject to CGT.
If you're not a UK tax resident, you will typically only be liable for CGT on the sale of UK assets (such as property or land in the UK).
As previously mentioned, whether you are subject to CGT in the UK depends on your residency status, not the status of your citizenship. Therefore, if you are a UK resident, you will pay CGT on the disposal of a non-UK property. In contrast, if you are a non-UK resident, the disposal of non-UK Property will not be subject to UK CGT.
CGT is only applied the gains you make, not the total amount you earned from the sale. Gain is the difference between the price you sell the asset for and the price you paid for it, including any associated costs (like legal fees, agent fees, and improvements to the property).
For example, if you sell a property for £400,000 and you originally bought it for £250,000, your taxable gain would be £150,000. CGT would be applied only to that £150,000.
The difference between CGT and NRCGT lies between the status of the taxpayer i.e. whether the taxpayer is UK resident or not.
CGT applies to UK residents selling both UK and non-UK assets. NRCGT applies only to sale of UK properties by Non-UK residents.
In summary, if you're a non-resident selling UK property, you pay NRCGT. If you're a UK resident, you pay CGT on both UK and non-UK properties.
