How to Complete and Submit HMRC VAT5L Form Online

If your business deals with land, property or construction and you are registering for VAT, HMRC may ask you to complete a VAT5L form. It is a short online form that explains the type of property transactions your business carries out or plans to carry out. You complete it alongside your VAT registration, save it as a PDF and attach it to your application. It is not a tax return and does not opt a property to tax.

The confusion usually arises because VAT5L is linked to property VAT and sits alongside the option-to-tax process, even though the two serve different purposes. Using the wrong form or providing incomplete information could delay your VAT registration, hold up a property transaction or affect your input VAT claim. This guide explains who needs to complete VAT5L, what information HMRC asks for and how to submit it correctly.

Key Takeaways

  • VAT5L tells HMRC about the land and property supplies you make, or intend to make, as part of your VAT registration. It does not opt a property to tax
  • HMRC may require the form where your VAT registration involves land or property supplies, particularly if you are acquiring, developing or working on property
  • Complete VAT5L online in one session, as you cannot save your progress. Once finished, save it as a PDF and attach it to your online VAT registration application
  • HMRC may request evidence such as Land Registry documents, a lease, solicitors’ correspondence, planning documents or architect’s drawings. Missing information can delay your application
  • An option to tax is a separate decision. VAT1614A notifies HMRC of that decision, while VAT5L explains the nature of your property supplies. The forms are not interchangeable
  • The current compulsory VAT registration threshold is more than £90,000 of taxable turnover, although voluntary registration and special registration rules may also apply

Who Needs to Complete a VAT5L Form?

HMRC may ask you to complete a VAT5L form if your VAT registration involves land or property. This is most likely to apply if you are:

  • A commercial landlord buying or refurbishing a property to let
  • A property developer building, converting or renovating property for sale
  • A property investment company or special purpose vehicle (SPV) buying commercial property
  • A construction business working on new builds, conversions or major renovations
  • A business buying bare land or commercial premises for development

You do not need to complete VAT5L simply because your taxable turnover has exceeded the VAT registration threshold. What matters is the type of supplies your business makes or plans to make. If land or property is not part of your business activities, HMRC is unlikely to ask for the form.

If you have already opted to tax bare land or commercial property, HMRC may require less supporting evidence because your intended supplies are more clearly taxable. However, VAT5L and VAT1614A still serve different purposes. VAT5L explains your property activities, while VAT1614A tells HMRC that you have decided to opt to tax.

Do All Businesses Need to Submit a VAT5L Form

You complete VAT5L as part of your VAT registration, alongside the main application. It is not a separate return that you file later.

Not every business registering for VAT will need to complete it. However, if your application shows that you make, or plan to make, supplies involving land or property, HMRC may ask for VAT5L before it can process your registration. If the form or supporting information is missing, your application may be delayed, which can also hold up your VAT number and the recovery of input VAT.

The form must be completed online in one session. Once finished, save it as a PDF and attach it to your VAT registration application. Because you cannot save your progress, it is best to gather all the relevant property details and supporting documents before you start.

What Information Does HMRC Ask for on VAT5L?

VAT5L asks about the land, and property supplies your business makes, or intends to make. HMRC may also request evidence to support the information you provide. Gather the relevant documents before you begin, as the online form cannot be saved and completed later.

HMRC may ask for independent evidence that you own the property, plan to acquire it or hold a beneficial interest in it. If development is planned, it may also ask for planning documents or other evidence showing what you intend to do with the property.

KEY STEPS FOR ASSESSING PROPERTY & STATUS

Ownership

Land Registry documents, a lease or solicitors’ correspondence.

Planning Approval

The relevant planning application, planning permission or a council prior approval notice.

Development Plans

Architects’ drawings or council pre-application advice.

Expired Permission

Evidence development began within the permitted timeframe or that you have reapplied.

You may also provide additional evidence showing that you make, or intend to make, taxable land or property supplies. Clear and relevant information may reduce the need for follow-up questions, although it does not guarantee that HMRC will process the application more quickly.

How to Complete & Submit the VAT5L Online Form to HMRC

The VAT5L form is fairly simple to complete, but it helps to have everything ready before you begin.

1. Gather your supporting documents

Collect any relevant ownership records, planning documents, solicitors’ correspondence and architects’ drawings. You cannot save a partly completed form, so missing information may mean starting again.

2. Complete VAT5L online

Open HMRC’s digital VAT5L service and answer the questions about the land or property supplies your business makes or plans to make.

3. Save the form as a PDF

Once you have completed all the questions, save the finished VAT5L as a PDF. Keep a copy for your records.

4. Attach it to your VAT registration

Upload the completed PDF with your online VAT registration application.

If you are not registering online, print the completed form and post it to:

BT VAT
HM Revenue and Customs

VAT5L & the Option to Tax: How do They Fit Together?

VAT5L and the option to tax are often mentioned together, but they do very different jobs.

VAT5L is used during VAT registration to explain your land and property activities to HMRC. It tells HMRC what supplies you make, or plan to make, but completing the form does not change the VAT treatment of the property.

An Option to tax is a separate decision. It will normally make an otherwise exempt supply of commercial land or buildings subject to VAT at the standard rate. This may allow you to recover VAT on related costs, although the usual input VAT rules still apply and an option does not affect every type of property supply.

You normally notify HMRC of an option to tax using form VAT1614A, not VAT5L.

VAT5L & the Option to tax: How do they fit together?

In simple terms, VAT5L tells HMRC what your property business does. An option to tax can change how VAT applies to certain sales and lettings.

This is a long-term decision. An option to tax cannot normally be revoked until at least 20 years have passed, and it does not automatically end after that period. Because it can affect future leases, sales, development plans and VAT recovery, it should be considered carefully rather than treated as a routine part of the registration process.

Worked Example: A Property Company Registering for VAT

Meridian Property Ltd buys a vacant commercial building for Â£600,000 plus £120,000 VAT. It plans to let the ground floor to a business tenant and convert the upper floors into flats for sale.

For this example, assume the purchase is not a transfer of a going concern and Meridian does not give the seller a VAT1614D certificate to disapply the seller’s option to tax. The seller therefore charges VAT on the full purchase price.

Meridian registers for VAT and completes VAT5L, explaining both parts of the project. It also opts to tax the ground-floor commercial area, meaning the rent will normally be subject to VAT at 20%.

Assume Meridian’s calculation allocates 30% of the purchase VAT to the commercial ground floor and 70% to the residential conversion:

VAT treatment

Without an option to tax

With an option to tax

Commercial rent

Exempt

Standard-rated

Purchase VAT allocated to the ground floor

£36,000

£36,000

Ground-floor VAT normally recoverable

£0

£36,000

Purchase VAT allocated to the flats

£84,000

£84,000

Flat-related VAT potentially recoverable

£84,000

£84,000

Total purchase VAT potentially recoverable

£84,000

£120,000

This assumes that the first sales or qualifying long leases of the converted flats meet the conditions for zero-rating. Zero-rated sales are still taxable supplies, so VAT relating to the residential conversion may be recoverable even if Meridian does not opt to tax the commercial area.

The option to tax therefore does not unlock the full £120,000. In this example, its potential value is the Â£36,000 allocated to the ground floor. Without the option, this VAT would normally relate to exempt rental income and could be irrecoverable. With the option, it will generally be recoverable, subject to the normal input VAT and partial-exemption rules.

VAT5L helps Meridian explain the mixed-use project to HMRC, but it does not determine how much VAT can be reclaimed. Meridian must separately identify the costs relating to the commercial and residential areas and fairly apportion any shared costs.

Before completing the purchase, Meridian should also consider whether VAT1614D could disapply the seller’s option to tax for the part of the building being converted into flats. This could reduce the VAT payable at completion, rather than requiring the company to pay it first and reclaim it later.

These figures are illustrative. The actual VAT treatment will depend on the purchase structure, intended use of the property, option-to-tax position, partial-exemption calculation and whether the residential sales qualify for zero-rating.

How Does VAT5L Affect UK Property Investors and Businesses?

VAT5L may be a short form, but incomplete or unclear answers can delay your VAT registration at a crucial stage of a property purchase, development or letting.

The form does not determine how much VAT you can reclaim. Recovery depends on whether your costs relate to taxable or exempt property supplies. On a high-value commercial property, the difference can have a major impact on cash flow and the overall cost of the project.

The more important decision is often whether to opt to tax. This may improve VAT recovery, but it can also increase costs for tenants or buyers who cannot reclaim VAT. In some cases, you may also need HMRC’s permission using VAT1614H.

Note

An option to tax is a long-term commitment and cannot normally be revoked for at least 20 years. VAT5L tells HMRC what you plan to do; the option to tax affects how VAT applies to those plans.

Common VAT5L Mistakes That Can Delay Registration

  • Missing evidence: Include any ownership, property or planning documents HMRC requests.
  • Confusing VAT5L with VAT1614A: VAT5L does not opt a property to tax. That is a separate process.
  • Treating exempt supplies as taxable: Residential letting is generally exempt, so related VAT is not normally recoverable.
  • Starting before you are ready: You cannot save VAT5L partway through, so gather everything first.
  • Applying too late: HMRC may ask for more information, so do not leave the application until completion is close.

A clear, complete and consistent application reduces the risk of delays and follow-up questions.

Conclusion

VAT5L may be a short form, but it can play an important part in a property-related VAT registration. Clear answers and the right supporting documents help HMRC understand your plans and reduce the risk of delays during a purchase, development or letting.

The form does not opt a property to tax or decide how much VAT you can reclaim. That depends on the supplies you make and any separate option-to-tax decision. Where significant VAT or mixed property use is involved, it is best to review the position before submitting the application rather than correcting mistakes later.

Frequently Asked Questions

Can I complete VAT5L before completing the property purchase?

Yes. You do not always need to own the property before completing VAT5L. HMRC may accept an application based on a genuine intention to acquire it, but it may ask for evidence such as solicitors’ correspondence, a proposed lease or other documents supporting the planned purchase.

What happens after I submit VAT5L with my VAT registration?

HMRC reviews VAT5L as part of your wider VAT registration application. It may contact you for further details if your property plans or supporting evidence are unclear. If the application is approved, HMRC will confirm your VAT registration number, effective registration date and information about your first VAT Return.

What should I do if I notice a mistake after submitting VAT5L?

HMRC does not provide a separate online service for amending a submitted VAT5L. Contact the VAT Registration Service promptly, explain the mistake and provide the correct information. If HMRC has already requested further evidence, reply using the contact details given in its request.

How long does a VAT registration involving VAT5L take?

There is no fixed processing time specifically for VAT5L applications. The time required depends on the information provided and whether HMRC needs to ask further questions. HMRC’s online reply checker is updated weekly and provides the most current indication of when you may receive a response.

Do landlords making ordinary residential lettings need VAT5L?

Not usually for the residential letting alone. Ordinary residential rent is generally exempt from VAT and does not count as taxable turnover for VAT registration. However, VAT5L may still be relevant if the landlord also carries out taxable property activities, such as certain developments, commercial lettings or taxable property services.

Can an overseas property company complete VAT5L?

Yes. An overseas company can register for UK VAT and complete VAT5L where its application involves UK land or property supplies. A business with no UK establishment must generally register from its first taxable UK supply, as the normal VAT registration threshold does not apply to non-established taxable persons. Exempt residential rent alone does not create that liability.

What happens if HMRC asks for more VAT5L evidence?

Provide the requested documents as soon as possible and make sure they support the activities described in your application. HMRC warns that missing information can delay registration. If HMRC ultimately refuses registration or makes another formal VAT decision, its decision letter should explain your rights to request a review or appeal.

Should I submit VAT5L and VAT1614A at the same time?

Often, yes, where you are not yet VAT-registered and have already made a valid decision to opt to tax. HMRC says the option notification can be included with the VAT registration application, and it must normally be made within 30 days of the decision.

Do not submit VAT1614A automatically simply because you are completing VAT5L. If prior permission to opt is required, you must apply using VAT1614H first and follow HMRC’s permission process.
