Give Wisely: Avoid Hidden IHT Charges

Gift with Reservation of Benefit (GWROB) & Pre‑Owned Asset Tax (POAT)

Gifting assets can reduce your estate for Inheritance Tax (IHT) but continuing to benefit from gifted assets triggers anti avoidance rules. You'll either face the gift with reservation rules or pay the pre owned asset tax (an annual income tax charge). Understanding these anti‑avoidance rules is essential if you want your gifts to be effective.

What Is a Gift with Reservation?

A gift is normally exempt from IHT if you survive for 7 years, but this exemption does not apply when you continue to use or benefit from the asset. HMRC treats these gifts as if you still own the asset:

  • If you transfer a house to a relative or to a trust and continue living in it rent‑free, the gift is deemed to remain in your estate.
  • If you give away a caravan or valuable painting but continue to use it for free, it is a gift with reservation.
  • The market value at the time of death is included in your estate, no matter when the gift was made.

How Can You Avoid GWROB?

  • Pay market rent: If you continue using the asset, paying the market rent removes the reservation.
  • Give up the benefit: Move out of the gifted property or stop using the asset at least seven years before your death.
  • Use trusts cautiously: Certain trust arrangements still attract the reservation rules; professional advice ensures compliance.

Example

Consider someone who transfers their house into their children’s names in 2011 but continues living there until 2013. When they move into a care home, the gift becomes an outright gift, and the 7‑year clock starts. If they die within 7 years, the value at the date the benefit ceased (not the date of the original gift) is subject to IHT. Paying rent at the market rate from 2016 would also end the reservation.

Understanding Gifts with Reservation of Benefit (GWROB)

Concerned a previous gift might be caught by these rules? We'll review your position and explain your options!

What Is POAT?

POAT is an income tax on the benefit of using assets you've given away, mainly property you still occupy. It was designed to catch arrangements that avoid the gift with reservation rules. You can choose to be taxed under the gift with reservation rules instead, which keeps the asset in your estate but avoids the annual income tax charge.

What Is POAT?

  • Property funding: If you transfer money to someone else to buy a property that you then live in or have the right to use.
  • Assets still enjoyed: If you continue to use gifted chattels such as cars or jewellery.
  • Arrangements where GWROB does not apply: POAT may apply where you fund the purchase of an asset but arrange things so that you do not legally own it, yet you still enjoy or use it, and the arrangement does not fall within the GWROB rules.

Elections

You must file Form IHT500 by 31 January following the tax year in which the benefit began. Once you elect the gift with reservation rules instead, the asset forms part of your estate and POAT does not apply.

Frequently Asked Questions

What counts as a gift with reservation?

A gift with reservation arises when you give away an asset but continue to benefit from it. Common examples include giving your home to someone else but continuing to live in it rent-free or giving away valuables but still using or enjoying them. Such gifts remain in your estate for IHT purposes.

How can I avoid the gift with reservation rules?

You can either give up the benefit entirely or pay market rent for continued use of the asset. Moving out of the property or ending use at least seven years before your death makes the gift potentially exempt.

What is the pre‑owned asset tax?

POAT is an income tax on benefits you continue to enjoy after giving away an asset. It applies to land, buildings, chattels and funds used to buy property. You can elect instead to pay IHT by treating the asset as part of your estate.

Do gifts with reservation rules apply to all gifts?

No. Gifts between spouses or to charities are exempt from IHT, and gifts you do not benefit from may become exempt if you survive seven years. The reservation rules only apply when you keep using the gifted asset.

What if I’ve already made a gift with reservation?

We can review your position and outline practical solutions, which include but are not limited to: paying market rent, ending your use of the asset, or making a POAT or GWROB election. We will also carry out the necessary calculations to compare the options, model the potential IHT and income tax outcomes, and help you choose the most effective way to correct and restructure the arrangement.
